Overview

These Terms of Service govern your access to and use of the LeadDataKernel website, products, datasets, and related services. By purchasing or using any dataset or feature, you agree to these Terms and the Privacy Policy.

Definitions

  • Customer Data: information you provide to us, such as order details or support messages.
  • Delivered Data: the datasets or files we deliver after purchase.
  • Authorized Users: your employees, contractors, or agents permitted to use Delivered Data for your business.
  • Sensitive Data: data requiring special protection, such as financial account numbers or government IDs.

Accounts and eligibility

  • You must be at least 18 and legally able to enter contracts.
  • You are responsible for your account, credentials, and activities under it.
  • Provide accurate information and keep it up to date.

Orders and pricing

  • Pricing is typically tier-based by row volume and confirmed at checkout or in writing.
  • Taxes, payment processing charges, and currency conversion fees are your responsibility.
  • Orders may require verification or alignment with applicable data usage rules before delivery.
  • We may reject or cancel orders for compliance or fraud concerns.

Data license and permitted use

Upon full payment, we grant you a non-exclusive, non-transferable license to use the Delivered Data internally for legitimate business purposes. Unless expressly permitted in writing, you may not resell, re-license, publish, or otherwise share Delivered Data outside your organization.

Acceptable use

  • No harassment, deception, illegal marketing, spam, or unlawful discrimination.
  • No abusive scraping or interference with platform integrity.
  • No use that violates privacy, e-communications, consumer protection, or similar laws.
  • No handling of Sensitive Data unless explicitly permitted in writing.

Privacy and DPA

We handle Customer Data as described in our Privacy Policy. Where required, a separate Data Processing Addendum may govern processing on your behalf.

Confidentiality

Non-public information exchanged under an order or support engagement is confidential and must be protected with reasonable safeguards.

Intellectual property

We retain all rights, title, and interest in the services, datasets, tooling, and content except for the limited license granted in these Terms.

Third-party services

Our services may interoperate with third-party tools such as payment gateways. We are not responsible for third-party services or their terms.

Warranties and disclaimers

  • Services are provided "as is" and "as available."
  • We do not guarantee campaign outcomes or downstream performance.
  • To the maximum extent permitted by law, we disclaim implied warranties.

Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount paid for the specific order giving rise to the claim within the prior 12 months.

Indemnification

You will defend and indemnify us from claims arising out of misuse of Delivered Data, violation of law, or breach of these Terms.

Suspension and termination

  • We may suspend or terminate access for material breach or legal and compliance risk.
  • Upon termination, your license to Delivered Data ends unless otherwise stated.

Refunds and replacements

  • For delivery defects demonstrably caused by us, we may replace affected portions or issue a partial refund.
  • Requests must be made within seven days of delivery with sufficient detail.
  • We do not refund results dependent on downstream usage such as response rates.

Compliance

You are responsible for complying with all applicable laws and industry rules governing your marketing and data usage. We honor lawful removal requests for Delivered Data we control going forward where feasible.

Support and service levels

Standard support is provided via email during business hours in Asia/Dhaka. Enhanced SLAs may be available under a separate agreement.

Changes to terms

We may update these Terms from time to time. Material changes take effect upon posting with a new "Last updated" date.

Governing law and disputes

These Terms are governed by the laws of Bangladesh. Courts located in Dhaka, Bangladesh have exclusive jurisdiction.
